Accuracy of content
We take care to keep information on this site current and correct. Content may change without notice, and nothing on this site forms an offer or a binding quotation. Written proposals issued by us are the only binding statement of scope and price.
Intellectual property
All content on this site, including copy, photography, design and code, belongs to 35 - 16th Avenue Media House unless stated otherwise. It may not be copied, republished or used commercially without our written permission.
Client work
Work commissioned from us is governed by the proposal, quotation or service agreement signed for that project. On completion and full payment, ownership of the final approved deliverables transfers to the client. We retain ownership of unused concepts and working files unless otherwise agreed, and we may show completed work in our portfolio unless the client asks us in writing not to.
Third party material
Where a project uses stock assets, fonts, music or software owned by third parties, the licence terms of those owners apply and licence costs are quoted separately.
Payment
Unless the proposal states otherwise, projects are invoiced with a deposit before work starts and the balance on delivery. Retainers are invoiced monthly in advance. Overdue accounts may result in work being paused.
Limitation of liability
We are not liable for indirect or consequential loss arising from the use of this website. Liability for commissioned work is limited to the fees paid for that work.
Governing law
These terms are governed by the laws of the Republic of South Africa.
